The former owner, the builder, would have to execute a “corrective deed” to fix the problem. Your title company who is handling the refi should be able to get this done for you.

My wife and I bought a new house 3 months ago from a builder. We were in the process of refinancing last week and discovered that my wife’s name is spelled wrong (by one letter) on the recorded deed (prepared by the settlement attorney). There is an “i” instead of an “a” in the name. The deed of trust signed to the lender has the correctly spelled named though
Is there a standard process to change the misspelled name? We are in Virginia. Can we still go through the refinance process as we do this?
