I would take your agreement to a real estate attorney (a title company should be able to recommend one) and see if the agreement is sufficient to proceed with selling the property and what your options are.

I am currently separated from my husband, he has quit paying the mortgage and left the state permanently(NC). How do I sell the property without him being present?

I would also think you could get him to sign a limited power of attorney dealing with all issues pertaining specifically to the property.

All of the documentation can be sent to him via express mail. He will have to sign everything in front of a notary or witnesses according to the state laws.

What if he cannot be located for me to do this then how do I sell this property? We signed an agreement to sell it but he took off with out signing anything over.
