Depends on the title for deed paperwork and the state law. Most of the time, both require the seller to grant clean title, meaning that you probably have a good cause of action against your ex.

after my divorce in 1987, I purchased a home from my ex-wife in 1989 who was in real estate at that time. I assumed a mortage and had a small contract for deed which i payed off within a year. I hired a title company to ensure everything was legal and correct. I was not given a quick claim deed at the time of closing. Last year I found out that a warranty deed should have been filed with the county once I payed of the contract for deed. This was not done until I hired a lawyer and had him draw up the paperwork and have my ex-wife sign it and I registered it. Now I am trying to refinance my property and I found out there is a Tax Lien filed in 1999 from the state of minnesota against my wife for back income taxes. Do I have any recourse???
