There should be a homestead exemption in each state that will protect your equity in your personal residence, and some personal properties (up to a certain statutory maximum, depending on your state).

I went to small claims court a few months ago and lost. I haven’t paid the judgment yet and just received a “Levy” against my personal name.
The notice says “you are commanded to levy on the property subject to execution of “MY NAME” in the sum of $XXX with interest rate of 8% a year from NOV, 2009 until paid.”
Does this mean that any property that i own in my personal name can be auction?
I have a motion in with the court regarding this same case and i’m hoping the judge will vacate this judgment against me.
Anyone run into this?

Actually, its not a levy but an execution. I understand from there, you can get a levy although its a process through the sheriff’s office.
