Oh yea, even if you have a trademark and don’t control it stricktly you will lose rights to it. Ask Bayer Corporation…they failed to do so and lost the rights to “Aspirin” Also, remember the time Coca Cola sued the little mom and pop restaurant because…customer would order a Coca Cola and served Pepsi instead.

You have to control or lose.

You can have a trademark for use in one state rather than doing so in the other 49. However it seem strange that she would have had this phrase as it, I am sure has been in use for a good number of years.
