The issue is disclosure. You disclose what you know and you offer the tenant an opportunity to inspect. That is all federal law requires.

I am interested in doing sandwich L/O subject 2 deals. I have noticed that quite few of my target properties were built before 1980’s. For thus reason, there is a possibility for the properties to contain lead paint and asbestos.
- How can I protect myself from a potential tenant/buyer health and liability lawsuit if I unwitting purchase a lead and/or asbestos containing property when selling via lease option? Do I simply have the home inspected before hand for both lead and asbestos.
