This is just a hypothetical at this point, but the point I am trying to make is that regardless of any lease option agreement that may be in place, you cannot remove a tenant in NJ without proper cause. A lease expiration is not proper cause.

Suppose my tenant buyer is at the end of the option term and decides not to buy, but also decides not to move. If he continues to pay rent, in NJ, I cannot evict him. I can only evict for cause (ie non payment, late payment etc.)

Any ideas?

Isn’t there something you can do having to do with non-performance on the Purchase & Sales Agreement?

And since you are now putting the house back on the market for sale, you have a good reason to get that tenant out, get the place cleaned up and ready for sale, etc., so give him 30 days notice and plan on having a new BUYER in there 30 days from now!!

I think he does have to move. I assume your tenant signed a lease option with you. This should have stated, he had a specific time to lease the home, and then by a certain date, either, buy, or leave. This better be the case if you also signed an L/O with the orginal seller.
