The new laws in Texas which regulate lease option transactions go into effect on January 1, 2006.
Right now, it is ok to enter into a residential lease, and a separate option contract.

Have a gorgeous home I just rehabbed. Have a man interested in purchasing for full price on a Lease with Option. $5,000 option consideration; $820 per month. (payment equal to 8% 30 year financing plus taxes and insurance).
The property is in Texas. Can this be done? Someone said lease-options are outlawed in Texas now???
