I am not an attorney, so consider my info for what it is. When you were awarded the judgement you proved your case. That part is over. You recorded the judgementand it attaches to the property. You can only collect when the property sells, if it is for sale it should be soon. The judgement will have to be cleared for the seller to give a clear title. The title company will find this judgement and pay it off at the closing out of the sellers funds. It is a waiting game now.

I have just placed a lien on property, I have gone through the court system and it has been recorded. The house is now up for sale, what can I do to make sure that my judgement is not overlooked.

Maybe I didn’t include enough info or maybe it’s the holiday… but I am anxious for a response so I’ll try this.

I have went to civil court to superior, won judgement. Defendant has property. The property is now up for sale with a lease-option. I do have a certified copy of the record. The judgement is not large, only approx $2600. I was told by the county assessor’s office, I will only collect if everything is perfect and to keep an eye on the property. So I am just wondering if there is anything I can do to help my case.

Judgment enforecment varies a lot by State. i.e.- what are the homestead laws in your State? You have done everything you can do for now. Not sure why it is that you think anyone at the County Assessor’s office knows anything about recording or collecting on a judgment.
