I have a friend in Saginaw, TX outside Houston that has had his mortgage payments almost double in 3years because of the 5-10% tax increases each year that neither he nor his lawyer was informed about. He is now delinquent in escrow for $4-6K, his tax appraised value exceeds FMV. Could this be a part of the Johnson Development Corp. and what recourse does he have?

Our masterplan community developer is bringing several thousand apartment
units into our single family neighborhood, Sienna Plantation. We weren’t told
about these initially, but apparently they were in the developers agreement
with the nearby city. We found out later, after a rather intense city council
battle here in Missouri City, TX (a small town near Houston), that the mayor
has been receiving campaign support from Johnson Development Co. and
pushing their projects locally. Is there anything we can do to stop this
development in our community?

You will need to analyze the statements and representations that were made to you, verbally and in writing, when you bought your homes.

The developer may have made intentional or negligent misrepresenations to you about the future parts of the community, or he may have intentionally or negligently failed to disclose to you the future parts of the community.

In either case, the developer may have some liability to you, but it is likely that a well-organized lawsuit, with a number of homeowners participating, would be necessary.
