Is landlord liable for bedbug damage? - Posted by Todd

We’re getting hit with the same thing in Illinois. Our legislature has a bill on the House floor that would put 100% of the responsibility of treating bed bugs on the landlord. As you can imagine we are outraged and planning to fight it. Also since the tenant would be absolved of anything in this bill, there is no incentive for them to report bed bug problems. So you better check it out cause this is a real issue going around the state legislatures.

Hoping for some feedback from people who have had some experience with this one. We own a tri-plex in Kentucky and recently had a minor bedbug outbreak in two of the three units.

As soon as we received the call, we were there the next day treating the entire building. We came to learn that the tenant had them for a while before calling us about them. She ended up having to throw out her mattress due to the bedbugs and is now requesting that we reimburse her for the cost of the mattress.

We have treated the building two more times since then and to our knowledge, the bedbugs are now gone. One of the tenants had allegedly called the building code people and that person indicated that the landlord was required to have their units professionally treated at least once per year. I had never heard of this before now and think this guy is full of it IMO.

Any feedback from people who have gone through this would be greatly appreciated. Thanks.
