Everybody kept calling it an “application.” It was some one-paged… thing. And I gave my account number to my friend. We’re friends for the past 8 years so I really thought I could have trusted her. A really complicated transaction in short: I got this fixed with a full refund.

I told the seller and everyone that I still wanted to think about, but they really pressured me into signing this “application,” and I was told that this application will not be processed. I signed it but DID NOT DATE IT. Within 12 hours, I find that money was taken from my account, and the terms of this (now) “contract” did not permit refunds. Generally, is the contract even valid when I did not date it?
How about a listing agreement that starts on 9/15/05 and ends on 4/15/05? The realtor did the same pressure tactic, but come to find out he wrote in the wrong date for the close of the listing period.(4/15/2005 instead of 4/15/2006) When I approached him to inform him that the agreement was null and void due to the date, he stated that it was a simple oversight, and that the law would look past the date error. Thanks in advance for any help on this…

When A leaves such a contract with B, undated, A has basically consented to B’s dating whenever B so chooses, so as to complete the K as and when B chooses.
If you hadn’t signed it, he could not have done that for you, but any other detail, such as date, legal description, etc., B might do legally.
Next time, of course, you won’t leave a blank signed K with the other guy.

Yes a contract is valid even if you didn’t “date” it. Sorry.
