My tenant is leaving end of this month and I still don’t have a lease signed from next month yet. The property is available from May 1st. She signed the lease until october of this year but I allowed her the provision to break it if she gave me 2 months notice which she did. I was reading the lease and it says that if I don’t get a tenant after she leaves, she is required to pay me rent until the lease expires or when I get a new tenant, which ever happens first. So my question is if I can keep the deposit until I get a tenant (the law in my state is to return the deposit within 30 days). What should I do? Please advise.
