I’m not an attorney. How much is the deposit? How much is one month’s rent?
It seems that if your deposit is equal to one month’s rent, that she wouldn’t have anything due to her after 30 days anyway.

My tenant is leaving end of this month and I still don’t have a lease signed from next month yet. The property is available from May 1st. She signed the lease until october of this year but I allowed her the provision to break it if she gave me 2 months notice which she did. I was reading the lease and it says that if I don’t get a tenant after she leaves, she is required to pay me rent until the lease expires or when I get a new tenant, which ever happens first. So my question is if I can keep the deposit until I get a tenant (the law in my state is to return the deposit within 30 days). What should I do? Please advise.
