-on the law in that jurisdiction
-on whether the purdent (prudent (?)) information was material? etc. etc.
You’re going to have to divulge more information to get a decent answer. I would call a plaintiff’s lawyer that handles real estate litigation. After he hears your tale, he will either accept the case or refuse it. If he refuses it, ask why and then get a second opinion like you would from a doctor.
If I gave you an answer, you would need to double-check with an attorney anyway so why not just skip this step.

Depends entirely on the Statute of Limitations for your state…each state has varying time limits for each different infraction.
