Depends where you are. Check your state. Florida statutes say:

83.59 (3) The landlord shall not recover possession of a dwelling unit except:

(c) When the tenant has abandoned the dwelling unit. In the absence of actual knowledge of abandonment, it shall be presumed that the tenant has abandoned the dwelling unit if he or she is absent from the premises for a period of time equal to one-half the time for periodic rental payments. However, this presumption shall not apply if the rent is current or the tenant has notified the landlord, in writing, of an intended absence.

If a person has clearly vacated the apartment, leaving no visible signs of occupancy. How long do I have to wait before I enter the property.

the way i handle this is Indiana is to take a few friends along with me the first time I reenter the property. they can be used as witnesses if need be. also, taking pics is not a bad idea, especially if they have left stuff behind. getting statements from the neighbors about the last time they saw anyone enter the property would be wise too.
