Hello
i am new as you could tell, and here is my question. i have read a few different places that when buying subject to you need to have the seller deed you the property. how does that work, does she file paperwork or just type up on a piece of paper that deed has been given to someone else. is there a actually deed that she justs hands to you. any help would be great.

Redline answered your question below… and there are lots of ways of obtaining the Deed to the property. The most conventional way is for the Seller to sign the Deed at the closing table. However I had a new experience today… in obtaining a Deed.
The proeprty that I am buying is a 1 acre building lot; not important as to what it was, but it is real estate. The sellers wife, (jointly held property) is in the hospital, and quite ill. This transaction has been in the works for some time and more a matter of my hectic schedule than anything else. Now that wife is sick and about to undergo surgery, it is time to get this wrapped up… so I go to hospital yesterday with an arrangement to have a Notarty from the hospital staff come Notarize the Deed… We wait a while and I am out of time… so we signed a few other docs not requiring notorization, and I left the Deed with them in case Notary shows up… I then left the hospital.
This morning the husband calls and says Notary showed yesterday afternoon later, and doc is all signed off. I said great, I’;; be over in 20 minutes to the hospital… he said he would meet me in front of the Hospital in the Drop-off Trun-around area… I said great… I whipped in with the top down on the covertible, handed him the 22K check he handed me the Deed, and that is how we got that one done… The Deed will record just as well as anyone done out of a formal closing… Kind of unconventional, but it works none the less… You might not want to try this approach until you have had a few more closings… LOL

When you purchase property, it’s said the seller deeds you the property. That means someone (a title company or attorney, not you hopefully) prepares a new deed. The seller signs this deed. You get the deed. Your title company and/or attorney has this deed recorded. Voila! You’ve been deeded a property.

Sure enough, come on over or down… depending on where I happen to be at the moment. I’ve been splitting my time between Ohio and FL recently, and will depart for the sunny south on Tues for another 2 week jaunt. Love to have you for a few days, if you ever wished to visit. Might even show you one of the Nursing Home closings while in town…
I guess the Deed pick-up today qualifies as a General Warranty “Hospital” Deed… doesn’t it… LOL Yes, as you mentioned, don’t try one of these in the car… because the disclaimer on the Deed says something like… “Objects may be closer than they appear”, as I glanced in the passenger side mirror…
