Is there a way to get someone off of a deed against his/her will quickly? This uncooperative person is letting a house go to foreclosure and the other person on the deed wants to salvage something via a short sale or “subject to” purchase by an investor.

Why not simply go to the uncooperative one and offer $$$ for a quit claim deed?

MONEY talks, maybe they have a serious $$$ problem and if there is equity and reason enough…put up the $$$, get the deed.

Who’s paying the mortgage? Is it the ‘uncooperative’ one? If so, you need to get the loan # and make the payments. Meanwhile have an atty talk to him and/or take him/her to court. Good luck,

Thanks for the input, Bill. Unfortunately, the husband comes from a rich family and he is doing this out of pure spite for his soon-to-be-ex wife to make sure she doesn’t get any money from the house. Amazes me how emotion often trumps logic.

Thanks, DJ. It is the uncooperative one who is responsible for mortgage payments and has not paid for 6 months. I doubt there is enough time to get a court order to get him off the deed so, short of hiring Tony Soprano as the wife’s representative, the house will probably go to auction.
