You need to hire an attorney at this point to determine the best course of action, which is likely a civil court action. Most areas have “simplified procedure” courts, which allow claims higher than small claims, but the procedure is simple, like small claims. If this is a limited partnership, then it may be more involved, which means going into a regular jurisdiction court and hiring an attorney. Either way, you should meet with an attorney right away to review the specific facts of the case.

I had recently asked this question in the general forum. I was recommended to ask this question in this forum. Here is my issue.
Last june (2003) I decided to invest some money for a real estate deal with an investor. The agreement was for a specific property in which he agreed to split the profit after the deal is over and I was a limited partner. However based on the conversations and the structure of the deal which he made, I decided not to invest for that property with him but the money was already given in the mean time. Hence by all means I did not agree for the struture of the deal. But he hasn;t given my money back so far. He keeps on telling some excuses like he will give the money after some other property of his is sold and things like that. Hence I am bit worried now. What should be my best course of action. Some people have recommended that to file in the small claims court but the amount I had given is much more than that. Is law suit the only way? I am sure the people in this forum will give me the best advices.
Thanks
Silvy

HI SILVY –

I have posted a few replies to you on this matter on the forums.

Now I have only one question: IS THIS “INVESTOR” a licensed real estate agent or broker or mortgage broker?
