That is a very technical legal question that can only be resolved by someone going over your purchase agreement. It all depends on what it said about the occupancy issues…get a real estate attorney where you are to look at it and advise you.

We recently sold our home in AZ that we lived in for 6 months (new construction by Shea Homes). My husband lost his job and had custody issues that forced us to move back to Colorado. We are now being summoned by Shea claiming a breach of contract and we owe them an exhorbant amount of money due to us not maintaining primary residency for 1 year. Can they legally do this and what are our options?
