Send them a stern letter demanding that they repair the A/C. Tell them if they do not, that you will report them to the appropriate business agencies and will sue them for damages. This would likely be a small claims action which doesn’t cost much and lawyers are not allowed. Most small claims judges will try and find for the consumer in these type of cases.
What can I do about Home Buyers Resale Warranty Corporation failing to replace my recently condemned central A/C unit?
The corp. left a msg on ans mach yest. stating that they will not replace unit, even though heating & AC company they sent out to work on unit has condemned it. The warranty corp’s reasoning is “unit is rusted out because of homeowner’s failure to keep unit clean”. Repair technician however, did not state this in his report. He stated “Unit not blowing air as it should. Drain pan has a crack. Blower motor has been shorting out. Needs to be replaced and rewired.” I just revwd limitatns of liability of warranty & it lists the following: “The Service is not liable for repair of conditions caused by misuse or abuse, failure to clean or maintain specified by the equipment manufacturer…”. The technician who presented at our home to make repairs couldn’t even discern who is manufacturer of AC unit. It’s located underneath our home. Do we have any legal recourse or avenue of consumer complaints? Does this corp. have complaints/lawsuits against it (past/present—couldn’t find info on internet). If no recourse, what can we do? We are not financially able to replace this unit on our own AND do not believe that we have been negligent in the unit’s care or maintenance. Any advice is greatly appreciated.

I had a similar experience. I my opinion, these warranties are a waste of money. Our company changed $100.00 to come out to inspect the AC unit, then told us it was not covered. Ok…so now that have more money. Once you get into the system, you will see it is obviously designed to go to great lenghts to avoid repairs. One more point - the home warranty company farms out these repair jobs to local contractors. You just don’t know who you are dealing with and we found that virtually nothing motivated them to do this correctly or in a timely manner. I feel your frustration.
