Talk to HER, ask her to quit claim the property to you. This is making the assumption she doesn’t want anything to do with the house anymore. Then you won’t have the real estate problem. Alternatively if she balks, give her some $$ for a quit claim and ask her to sign.Then the house is YOURS.

Don’t screw her over, cause it WILL come back to bite you in the A$$. I know.

I own a home in Southern California. I am in the middle of a divorce. She has moved out leaving me to pay the mortgage. My question is, Has she abandun the property under real estate law, if so what rights has she given up? Can I recover her share of the mortgage? We are both joint tenants on the deed and the lenders note.
