You also need to find out the governing body for contractors and put them on the GC’s tail. it is illegal to sign contracts if you don’t have a license or it is suspended. IT IS A CRIMINAL OFENSE!!
(Please check local and state Laws,as well as a qualified lawyer, as I am not an attorney)

Next time check out the contractor before you do business with them.
In AZ It is the Arizona Registrar Of Contractors.
I am a GC who is also an investor.

I purchased a property awhile ago and got screwed on the rehab. So to help a different contractor offered to purchase the property and keep up the mortgage payments and taxes. She also agreed to fix it up. I had a management company at the time to handle everything for me. They drafted up a contract that was signed by both parties.

The only problem is that she signed the contract in her companies name which at the time had her licensed revoked by the secretary of state and to this day still is. I want the tenant thats in there either out or to pay the rent for the area. But I do not have a contract with that tenant thats in there and they refuse to sign any new docs. But the contract with the contractor is null and void.

The contractor will not come to any agreement to rectify the situation. And has put a lien against the property for the work she has done and the lien is in her companies name.
And I need to refi…badly.

And to make it all even worse the tenant is her mom. And This contractor has an attorney that can keep her mom in there without any payments for a very long time.

What the heck do I rid myself of this one. Any and all ideas excepted even the unconventional :).

From your posts it sounds like you need to quit investing in real estate or put an attorney on retainer.

In both cases your first step should be to start eviction procedings as of yesterday, that is step one on the road to recovering control of both these properties. Step 2 will be file and get judgements against every party involved. Step 3 will be obivious after steps 1 and 2 are taken.
