No. You inspector, if they were any good (and many are not) should have noted water marks and/or damage in the basement. A hose won’t do this unless there is a drainage problem and its left on for a very long time. However, bottom line, you have to exit the deal before closing or you are stuck.
If its tenant occupied, you cannot even claim they hid it, all they have to go on is what the tenant told them.
My husband and I purchased a home about a year ago. Once we moved in, the basement flooded twice within the first two months. We had a home inspection and there were no findings in regards to the basement. The seller’s disclosure stated the tenant who was living in the house prior to the sell had moved a hose too close to the foundation and there was flooding, however, “all is ok”. We have spent $1500 to repair the problem and will need to invest even more to replace padding and carpet. Do I have grounds to go after the former owner for these costs? Help! Thanks.
