You should…there should be a clause in the sales contract that says if the buyer is unable to secure financing, you can get out of the contract and get your earnest money back.

I put in a contract to buy a rehab property for 90k. The Realtor without the seller asking for proof of funds to pay the 90k,put in the contract, but my HardMoney lender will only loan 85k? Since the seller will not accept a lower offer? Will I get my earnest money deposit returned?
