That informed him that he had to many people staying in the house and filed an eviction. At court they gave them a number of days to be out! The notice was put on the door yesterday that they have a few days to leave. Went to the court to file a stay of eviction and it was denied. This is a person with 5 kids what can they do?

Get an atty. It sounds like it could be a violation of fair housing law due to familial status. If the eviction was simply due to “too many kids” then it is. If the number of people exceeds the number allowed per the lease then there is nothing to do. However, if that number is less than two times the number of bedrooms plus 1, then that would be considered a fair housing violation (this is per local HUD office). Hope this helps in time. I recently learned these things at a fair housing seminar for landlords. Much cheaper than learning them in court!

The date on the door is posted about 7-10 days early to hopefully scare the tenant out before actual eviction. Two things I might suggest. Talk to the landlord and ask for either an extension (must be in writing) or negotiate a different price for the number of people staying there. It is more economical for the landlord to NOT to the eviction. 2) Do not let it go to an actual eviction. This will make it very difficult in the future, and everything WILL be put out on the street - and that is no fun. Start looking for a place now and get signed up for one before you get that eviction on your credit report.

They’re going to have to vacate that property or be in contempt of the court. Once the court ruled, it’s over with, except for the opp. to appeal which is costly and usually accomplishes nothing.

Since you’re a friend, you can help them pack their things and move.
