I’m not fish & game but based on what the we site says, it down’t sound like you’re modifing anying just cut trees.

Fish and Game in Calif. has a relatively new regulation which says people must notify State F&G of any activity which “diverts or obstructs the natural flow of, or substantially change or use any material from the bed, channel, or bank of, any river, stream, or lake?”. I haven’t been able to get F&G to simply give me a definition of “stream”, as the term appears to be ambiguous. And to top this, to get an answer out of F&G, you’re suppose to send them fees of $154 to thousands of dollars, when the County road department could probably quickly tell you whether it’s just a drainage ditch.

I have a man made drainage ditch crossing my property carrying water from a County roadside drainage ditch, and I want to cut down a few trees around it (but not in the ditch, nor on the bank), and someone said I should now check with Fish and Game. No other water enters my ditch except what comes through the County’s culvert. There are thousands and thousands of small drainage ditches throughout the whole state, which carry road runoff water and basically only have water in them after a rain, then they dry up.

Where do you go to find out how “stream” is defined, if it is not defined in their regulation? Has anyone delt with these “drainage ditch” issues?
