My Tenant is facing eviction, in a way to help her I called a number that she had given to me to contact her. When I called this cell phone number, I asked for the Tenant. The person who answered stated that she was her Mother and could she take a message. I asked how I could get in contact with her daughter, that my call was important. I proceeded to tell her what was needed from her daughter to avoid eviction and which time she told me their life history of depression and started to cry. I apologized for calling her, and the reason I called her number was because her daughter had told me to contact her at that number. At no time during the conversation did either of us raise our voices, nor did she ask me not to call again. She asked how she could help. The following day, there is a message on our answering machine from our Tenants Mother stating that her Therapist recommended filing harassment charges against us. This was the only phone call ever made to her. Should we be concerned?

Chances are your state law would define harassment as more than one phone contact. If the person told you to stop calling and you did not, then you might have something to worry about.
This is just a scare tactic. Don’t worry about it. Just don’t contact her again and do as John mentioned, stick to the eviction laws and have no further personal contact with either the tenant or mother.

see if it’s legal to tape record calls in your state.
I found a cute PC program that uses a voice modem to recored the conversation to disk.

I would make some notes and date them so if you are asked later
you can remember clearly.
I would suspect you will hear nothing further. Other problems may
keep her busy so you will fade from her mind.
I would also spend less time trying to help the daughter and make
sure you follow the legal process. Stick to the rules and be efficient
and polite with any contact.
Keep good records for any paperwork legally served, etc.

What’s this program called? Where can it be had? Does it do the opposite of what you described, namely pumping sound files into the phone line?
