This is not good advice, as you’re advising the Agent to violate the law…and not telling the RE Broker would be a clear violation of his RE licensing law as well as a breach of his agency contract that would be grounds for the broker tossing him out on his ear and probably causing him to lose his RE license permanently.

If I ever caught any agent of mine trying to hide something from me, he/she would be out the door quicker than he could blink.

Hi,

My girlfriend and I just received an offer on my house. She is the listing agent, and the buyer does not have an agent. Her real estate company is now telling her that it is illegal for her to also represent the buyer, as it is a conflict of interest. This situation does not make any sense.

Please help!

VEYR doubtful. This is state law of course. But in Cali it’s called dual representation. The standard realtor’s purchase contract should cover this.

What state are you in? In Virginia, there would be 2 choices:

She could represent both of you. In my opinion, representing both parties is a conflict of interest; however, the law allows it.

OR

She could just represent you. That would make the buyer a customer, and you her client. Her allegiance would be to you.

The bottom line is that she must follow her broker’s policy, even if the law allows her to do more.

It’s not illegal, but it may be considered a violation of “license law”. Best solution, have someone she knows and trust who works in her office represent the buyer, then have that agent pay you girl a “referral fee” out of the commision earned AFTER closing. Either a percentage or a flat fee. Some brokers frown on this, some don’t. Best bet, do it on the “down low”, on the sly, don’t let the broker know.
