Many state stautes specifically state that no licensed professional can limit or avoid his professional liability by use of corp or LLC.

So while you could form one, no, it’s not likely to give you any protection in any “malpractice” or misfeasance action arising out of your negligence while acting as REA.

Now, question for you: Why didn’t you take up this question with your RE Broker? If you can’t openly talk to your REB, you probably should find another REB with whom you can openly discuss things like this.

Is there a benefit for a real estate broker to form a corporation to do business? Will the corporate structure limit liability for malpractice or in any other way? Or is it better to spend the time and money on additional E&O insurance? Thank you.
