FL Rental Law - Posted by Dman

Without knowing or reading the law, the first thing I would do is read the lease. Does it have any clauses regarding breaking the lease in the event of job loss/transfer/etc.?

If so, then whatever the lease says (presuming it is not in contravention of state law) would control.

If the lease is silent, then you would look to state law. I do not know Florida rental law so I cannot comment here. My personal uneducated guess would be that it is unlikely such a provision exists, due to the potential for abuse by tenant (I want to break my lease - I can get “fired” to do so).

If you were the tenant in such a situation and needed to break your lease because you lost your job and could no longer pay the rent, I might advise you to approach your landlord anyway. Perhaps something can be negotiated. If you don’t ask you will never know.

Does anyone know if a loss of job, in FL, would be legal grounds to break a lease without penalty?
Thanks.

Here is a link to a great web site for Florida landlords that has the landlord/tenant state laws for Florida. www.floridalandlord.com

It wouldn’t be if your lease doesn’t state that. Check your states landlord-tenant laws so your on the up and up about things. You should be able to check this right from your pc. Look under state gov. for FL.
It should be in the governers section.
