I didn’t know what you meant by toter. I thought you meant tote the note. The PM might be willing to let the MH stay in the park. I will see if they are interested in getting started, since it seems to be out of hoc. I could do any necessary clean-up and they could be getting there lot rent again. This unit is as nice as many in their park. But overall a nice park. They just dont want possession of homes. Maybe I am just the guy they need.

Someone left when they were behind on lot rent, and their MH payment. The park mgr is new and said they can’t find where he went or who loaned him money. Basically it is abandoned, and he probably had it payed for. What can the park do? They aren’t getting there rent, yet the guy owns the home. What gives?

Actually, this is not uncommon.
The only thing the park can do is wait. Wait for a bank (if financed) to contact him. Most banks wont pay the space rent until they actually take possesion.
The park could begin court proceedings at anytime the lease is in violation. Once the court issues a writ of restitution, he can give it to a favorite toter guy so he can have the space back.
After that, both the park and the guy who takes it out will have a financial interest in the home. Best bet for the park is to just let him get a title to it or put it on a mountain somewhere, sell it and forget about it. Yeah, I know that dont sound legit but…it happens, all the time.

Well, this guy is in violation. So what keeps the court from moving? Only 2 months have passed? I might want to be the “toter guy”. What is the best approach towards the PM to spur legal action if I want to get the title? Any at all?

This sounds like someone is draggin their feet. Has the park owner/manager filed for the writ ?
After two months, you’d think it would be getting ready to go down the road. I would have a hard time believing the court system is backed up that bad.
If you want to get the title, I guess the first thing you need to do is find out who has it. If the park has it, they may want to negotiate something to cover their losses. I think if you explain to them you’ll take it out of the park, do all the work to get it out of their hair…and you’ll be glad to do this for free, you may be able to get a deal on it. Now keep in mind, You need to have YOUR paper work together and be sure that if you need permits to move it, you have that taken care of also.
Now, here comes a problem, IF the home was financed and the people file for bankruptcy, it could be in court for months…or longer. Remember the song “Can’t touch this”…there you go !
