Sure they do, but they already aren’t paying, so what are your chances of getting it??!!! You can get the judgement, but you probably won’t be able to collect on it. Mainly I should think you want them OUT NOW! State law is different regarding evictions, but I would think, that yes, they are obligated, as long as you use reasonable efforts to get it rented (i.e., you can’t not advertise, or ask an exorbinant amount for the rent so it won’t get rented, etc.)

besides having a hard time collecting the rent for the period after they move, you could NOT re-rent it under the judicial principle of UNDUE ENRICHMENT. I’m not an attorney and don’t play one on TV.
