I’ve been the victim of the recession by losing my job and
was renting a home in Atlanta for the last 12 months which has never been late ($3,500 per month)

Well the lease expired in june and I have not been able to pay the rent.

The landlord filed and I was served an eviction notice on July 30th.

My question is …What legal rights do I have since the lease expired June 30th and now the Landlord wants to evict ? can I buy more time to get my family out and find a place since there is no lease agreement ?

A couple of things…One, What recession are you speaking of? There is no recession in Atlanta (I know, I live here) or in the country. That seems to be the buzz word that keeps get thrown around. Media just loves it. It instills fear in the public therefore increasing their ratings.

Secondly, how are you a victim of something that does not exist? I am sorry, you did not pay the rent. You need to move. If you are experiencing hardship, does it seem right to push that onto your landlord? He has a family as well. If you are not going to pay the rent and want to stay there longer, where will the landlord get his money to cover his expenses? Your best bet is to find a $1000 rent and start again.

Stopped being a landlord in Atlanta a few years ago, so I may not be up-to-date with all the rules. As far as I know you have to be given 30 days notice, before he can file for eviction. Usually you go to court and with a sob story the judge might give you another 7 days.

With that being said: $ 3,500/month is a lot in rent in Atlanta. you would have to be in a pretty pricey neighborhood to be paying that, especially, if you’ve only lived there for the past year at a time when landlords were still desperate for renters.

Put yourself in the landlord’s shoes: he has to pay for the mortgage, possibly in a house that lost a lot in value. Maybe he’s upside down. He can’t subsidize you.
just because someone owns a house, doesn’t mean they’re rich. There’s usually a mortgage involved and he/she is on the hook for it.

This is really not the board where you’d get sympathy, as many of us are landlords, who had to deal with tenants that didn’t pay rent for whatever reason. yes, you’re going through a tough time, but it looks as if you’ve lived way above your means, if you paid $ 3500 in rent and didn’t even have enough savings to pay for an extra month. Situations like this are many times necessary as the ‘kick in the butt’ for people to wake up and rethink their life.

I’m no expert, but I don’t believe the landlord is under any obligation to renew the lease. When it expired it you became a month to month tenant if you didn’t enter into a new agreement.
