I learned this one the hard way. Now, if the tenant is late on the rent by the 3rd of the month, my property manager files in court. So far, it’s working. They know I’m not messing around with them.

I have a tenant, he paid me when I signed him up (security deposit and 1st months rent) to move into my rental house in April. He has not given me one penny since.

How do I get rid of this worthless mistake in my house?

I sent him a 30 day eviction notice about 2.5 weeks ago.

Is the 30 day eviction notice required?? or can I get him out sooner?

If I go to the house on the day of the eviction notice is due, and he is still there how to do proceed to get him out?

I am in Minnesota.

The day to go to the house is the 1st day the rent is late. I don’t fool w/letters, & seldom use the phone. I have worked hard to establish a reputation w/my tenants as a landlord who expects to be paid ON or BEFORE the due date. I’ve served a pay or quit notice as early as the 2nd of the month. It is important to train your tenants. If not, they w/train you. It’s kinda like potty training–difficult, but necessary, & the rewards are worth the work. I hardly ever have a tardy tenant, & 3 weeks ago I had a woman literally run after my car on clutching $100 bills in her hand.

When May rent was late (probably on the 5th), you should have send the tenant a Noitice to Pay or Vacate. In Texas, this is called a 3 day notice. This starts the ball rolling. I can have a tenant out in less than 3 weeks.

The key is NEVER allow a tenant to get this far behind. If you end up getting ripped off for 3 months rent, 2 of these months are self-inficted.

Remember this. ALL TENANTS ARE SLIME.

Some of this depends on state law. In VA it is 5 days.
Then you can file for a eviction.
If you have never done this yourself seek legal help to do this. It will be worth the attorney fees.
Every landlord has this come up sometime, it is just a part of the job. The better job of screening you do the less likelyhood of this thing happening.

I started my law practice in NYC doing hundreds of evictions on rent-controlled apartments. I’ve owned countless rentals over the last 15 years and still have dozens of tenants. I’ve heard EVERY excuse in the book.

Be nice, communicate with your tenants, try to work it out, but ALWAYS GET THE LEGAL BALL ROLLING EARLY! You can still discuss it, but always serve the notice of non payment by the 6th, and file the eviction by the 15th. You can always withdraw the proceeding if you get paid.

my experience with tenants started in 2000. I dove into the biz during a period of time when the “cream” of the tenant population was buying their first homes.

I have seen the relative economic status of the “median tenant” drop precipitously during the past 6 years.

A typical tenant lives hand to mouth and week to week. All it takes is an unexpected car repair, a bad weekend at the casinos in Shreveport or some particularly good dope----and they will flake out on me.

I have a handful of elderly tenants who are very dependable. and as a class, elderly tenants are absolutely my best. but even they go south on me.

I stick to my basic assertion. All tenants are slime. The ones who have not excreted their slime just need a little more time.
