Generally it takes up to 30 days to issue an escrow refund. I would suggest writing them and giving them a history of the phone calls, who you spoke with, and the promises they made. I would also suggest that you copy this letter to their regulator (Office of the Comptroller of the Currency) and the Department of HUD in Washington, D.C. (HUD is the watchdog for RESPA). Their addresses can be found on the Internet. Everything from this point forward should be in writing so you will have a paper trail.

Could someone tell me if I may have a legal issue in regards to an escrow refund check. I refinanced my mortgage and received a letter from my first mortgage (Countrywide) that the mortgage was paid in full on 6/6/05 and that I would be receiving an escrow refund check ($2,126)within 30 days. I never received the refund check. I sent them a letter stating that I never received the check and could they please reissued another check. They responded by letting me know that the original check was never cashed and never cleared the bank and they would overnight another check. It is now 8/15/05 and I still have not received a check. I’ve called every day to check on the status of my escrow refund check and everyday I’m told it’s going to be issued right away. I don’t think they intend to issue me the escrow refund check. Is it legal for them not to reissue me another check? Don’t they have to reissue the check by a certain date?
