An officer generally cannot make court appearances on behalf of an entity, whether corp. or LLC. An individual can represent themselves and make court appearances, but an entity cannot. Even in a single-member LLC, technically, the single member cannot make appearances. However, some judges may let it slide.

It is my understanding that a corporation would have to have an attorney appear on its behalf should a court appearance be necessary. An officer, and certainly not a shareholder, could not make that appearance. Is this correct? Does the same hold true for single and multi-member LLC’s or could the member appear if necessary?

You need to check your local civil code to see what the regulations are. In my state (Colorado) and officer can represent the entity in court for small proceedings (landlord-tenant, small claims, etc). In my former state of practice, NY, all entities need a lawyer. Check with your civil court clerk.
