Back in spring 2003, I put up decorotive rocks that encrcroched on the next door property about 6 inches by 2 feet… a very small area. At the time, the property owner stated that this small area did not bother her. In the spring 2004, she got mad at me and decided that she wanted me to move the stones. I said no! per our first year you said it was OK that the rocks were there. In addition, I discovered that prior to moving in 2000 they repaved ther drive way that overlaped on my property 1foot deep by fifteen feetlong.I stated to her that she also encroched onto my property but this doesent bother me.I also stated to her that if she wants me to move the rocks off her property she is going to have to remove the repaved area that encroched onto my property. Nothing was said all summer because now she knows that she has move her pave drivway that overlaps my property.Spring 2005 her husband removed that 1 foot by 15 feet overlapping my property. In the process of removal of the pavement, he took up some of my pavment and did a lousy patch job and frankly looks horrible.

  1. Do Ihave to move the rocks off her property even the 2 years prior she sad it was ok.
  2. Do I have the write to sew her for the repairs of the lousy patch job of the pavment that her husband did?.
  3. She sent me a letter demanding that I remove the rocks in thirty days.After 2 years,she decides to do somthing.
    Do I have to move the rock in thirty days?

She gave you a license to have your rocks on her property. She then revoked that license. Now you must move them.

What about the bad patch job they did on my pavement?
It is not pleasent to look at. Can I sew her to fix the bad job they did? plus Idid not give them permission to remove the overlap on my property. This was trespassing? Should I file a Police Report?

If she was my neighbor I would do whatever it takes to get along with her again. Did you ask them to redo the patch job? Are you even on speaking terms with her? I had a neighbor that I didnt get along with a couple of years ago. We went from having barbecues together to not even looking at each other in about 24 hours. If I was you I would tell her that I would remove the rocks if/when she repairs your driveway to your satisfaction.
