encroachment on an easement - Posted by Todd Foster

There is a 60’ wide easement on the lower side of my property. The question is, since a mobile home was placed on about 20’ of the easement about 15 years ago, does it need to be moved or has that part of the easment been forgiven? Also, when someone has an easement, are they allowed to bulldoze trees etcetra on their easement to make the roadway?

Thank You, Todd

I bought a trailer park that has a 60’ wide easement on one side. The seller didn’t disclose a problem with the existing mobilehomes encroaching on the easement. The trailers have been there at least 20 years. Do I have to move them or is there a time limit since they have been there so long?

Todd:

Litte more info plese…an easement is the right or privilege to use someone else’s property.

Is this an easement for you or for someone else?

Are you saying the mobile homes block the easement?

What is the specific problem?

You would have to go back and check the recorded easement…some expire…others do not.

Good Luck,
