Municipalities do not take property through adverse possession. The can and do take it through eminant domain.

There is not much you can do if they decide the need a new fire station or police station and your property happens to very nicely fit their needs.

About all you can do is show them other property in the immediate area, question their needs, attend their meetings and express you views, etc.

You might look up the “Poletown Decision” in the Michigan courts and see if you can get any good info there.

Good Luck,

I have a 6,000 sq ft office/retail building that has four tenants and the property is held via an LLC. The building is adjacent to a County Park and the zoning classification is Neighborhood Commercial. I have owned it since 1999.

How can I insure my property is protected from any entity that may want the property for their desired needs. I have heard of some success stories, but recently have witnessed the City taking three different properties thru Adverse Possession.

Comments on protection measures would be appreciated.
