Tell them you want your money back. Chances are, you will get it back. If not, you could file a claim with your local Better Business Bureau, and you would probably get it back soon after the builder is notified of your claim. They don’t want claims like that available for public view.

Something similar happened to me a few years ago. The builder could not get a clearance to pour the foundation because the soil had too much vegetation in it. It was failed 3 times by the county. They had a soil analysis run and it indicated they needed to scrape the lot and start over. That was the plan until suddenly one day I rode by and the foundation was poured. I was highly upset. I spoke with my salesman and asked what happened and he said they found an inspector that would pass the soil. I told him I did not want the lot. The builder was willing to refund our money, but I actually wanted the home. We selected another lot (which ended up to be better than the 1st because of the location of the pool). It ended up to be the best constructed home I have ever purchased, probably because the builder knew I was checking out their progress (or lack of progress) at least 4-5 times a week.

I put down $3000 earnest money to build a house. When they poured the slab for the house, I realized that the house looked like it sunk into the ground and not level. They offered me another lot but I don’t it. Do you think there is any way I can get my earnest money back?
