You can be a contract owner of the house and sign the listing agreement as long as everyone knows what the deal is.

Hello,

I am in the middle of doing a shortsale. I have the shortsale approved. I then listed the property to sell to a retail buyer. My question is… my real estate agent will not put my name on the Purchase and Sales agreement because my name is not on the Deed. Can someone tell me how I should respond to this? I have an attorney that will do a double closing but he is not available at this minute to answer this question.

Thank you for your help
Nikita

Nikita,

Let us know what your attorney says, because I don’t see listing a house where you are the contract owner as a problem as long as everything is disclosed in both the listing and the purchase contract.

Does your attorney see any issues with the end buyer’s lender, or will you be selling to a cash buyer?

If I where you I would have tried to sell it yourself most realtor take there time and just list it on MLS hooping for another realtor to sell the listing…try selling on craiglist, Please give us the number on your shortsale and maybe one of us could point you in the right direction.

In order for an agent to list a home they have to have the owners signature, otherwise an agent could just run around and list anybodies house.
