First, send them a certified 5 day notice. You can get the AZ format from www.drevictor.com, the website of the top landlord attorney in the Phoenix area. If you are in Maricopa county (Phoenix) and he says you can evict, he charges a $100 flat fee for the eviction. Just run it through like a regular eviction unless he says you do not have the right because of the way the lease is written. In AZ this is a fairly fast process and you could have possession in a few weeks. If you need a property manager to take care of getting it re-rented, e-mail me and I’ll send you the name of my current one and a second I interviewed and would use if the first one goes bad.

I wanted to know if services were also provided to obtain a judgment and follow up garnishment of wages for tenant caused damages and legal costs for deadbeat tenants that trash the rental home and then simply vanish without turning in keys or cleaning up their truckload of garbage left behind. Obviously their security deposit does not cover the damages or the last months rent and late fees or any legal costs to pursue recovery of all damages. Thank you

does follow up in court and go for garnishment in the jurisdiction where they find the debtor. For example on of my former tenants fled from AZ to MA and from there to FL. The agency is currently trying to track down assets in excess of what the courts will not touch before filing the case. They are careful not to waste money on a “judgment proof” person because in those cases you won’t even get back court costs because the just don’t have anything. They add that on to their collections fee when they go to court.

You have to have someone file in the state where the deadbeat is earning money because a judgment in one state cannot garnish waged earned in another as they have no authority to order an employer to pay the garnished wages to the Collection Agency.
