No, the foreclosure on the bank’s 1st will eliminate all other liens including the CC Co’s CC debt…and while the original debtor will still be liable for that debt, you, as new owner of the RE will not be liable for same. As long as you are buying at the foreclosure sale and are NOT assuming the debt on the house.

But be aware the CC Co. might be there bidding on it too, to protect their lien position…as if they don’t buy it, and there’s not sufficient funds to pay the 1st and them, their lien is history.

I want to buy a foreclosure in NC. It is for the First Mortgage. The owners have a default judgement against them for 2500.00 with interest for credit card debt?

Can the Credit Card company try to collect from me if I am successful bidder at auction?
