Deceased husband?

A friend of mine husband passed away. Does she have to go thru a probate attorney to quit claim the deed over to her?

She can’t deed H’s property

Nobody has a right to deed another person’s property so if she had no legal interest in it during H’s life she has none now.

She has those inheritance rights given her by the state of property’s location and this varies widely from state to state.

She does need to find a probate lawyer in that state and find out from him what that state’s law now requires of her.

Issue…can she sell as is?

Her bottom line is just that…whether she’s done enough to be able to pass title to a new buyer.

So a good place for her (or any widow) to start now would be to talk to a title co LPO (their trained legal officer) and ask what she’s going to have to do now to be able to pass title to a buyer. That will probably require her to buy a title policy and that’s a lot cheaper than hiring a lawyer…and then she and the title co can work together to cure or take care of any hitches in the title.
