Probably legal, BUT, you have a responsibility to safeguard those items.

In the future do what we do. In all of our contracts we stipulate that we will NOT close until the seller has removed everything and everyone from the property. We even drive by on the way to closing to make sure. It has pi**ed a couple of people off, but better them than us.

My husband and I purchased vacation property with a small cabin. The contract stipulated that the seller would have his items removed, and we would have access to the cabin two weeks after closing. The closing date on record was June 28th, two weeks ago today. The seller has not removed the padlock from the cabin and says he needs more time to “get his things out.” My husband wants to cut the lock, pack his things for him and leave them on the porch. Is this legal?

Probably NOT legal. Courts generally abhor self-help. This is a simple breach of contract issue. You could choose that route and sue for damages, or initiate a UD action. The UD action is likely quicker.
