I don’t think the passage of time transfers ownership to you. However, once the seller hears your “storare fee schedule” he may sign a document releasing it to you.

closing conditions - Posted by Mike

I had purchased a home in February of 2004. At that time one of the conditions of the closing was that the seller retained ownership of a hot tub/spa. The seller offered to sell me the spa, but i declined. It is now almost April a year later, the spa is still here, and now the seller has resurfaced to ask again if i want to buy the spa. At this time, my thought is that over a year has gone by with no word from the seller about the spa, or making any effort to remove it from the porperty. Am i correct in assuming that because of the time frame and storing the spa for over a year, that I may claim ownership of the spa, or does the original offer document still have precedence?
