Build your case with a search of your local city ordinances and what violations these OOS guys have committed.

If the properties are really bad your Health Dept would probably help you here by their inspections and finding of illegal conditions.

Also they’ve maybe violated a bunch of HOA Rules so that would be further cause of action for the lawsuit.

By the way, also know that frequently an OOS corp or LLC that should have registered itself with your PA Sec of State, Corp. Division, has NOT done so…and its failure to do so might cost it the right to respond or defend itself in your PA courts.

Whereas normally, mere ownership by a corp or LLC in another state doesn’t require registration there, if it’s renting RE, it IS required to be registered.

So go after those bad OOS’ers and nail’em for their slothful and pig-sty ways.

I am on the board of a Civic Assoc, and we have seen a large increase in “Investors” who live out of state and are not enforcing PA lease laws and leave properties in disrepair.

I know there is a precedence, just need to be pointed in the right direction.
