Due to faulty construction and possible mold, we decided not to purchase home with builder. They asked us to sign a release form to which we specifically wrote that “we expect a full refund of $10,000 deposit within 5 days of remarketing home”. Builder signed release form. They sold home within a week and refuse to give money back. Any legal recourse?

Can you prove the faulty construction? The part about the possible mold is more than likely true, as this is where 80% of mold begins…with new construction. However, that does not mean that it is harmful mold, as not all mold is harmful.
There is a difference in 5 days and a week. Did you try to work out an agreement for another lot with the builder? That way you at least will not lose your money.
If that does not work, try the better business bureau. Just make sure you have all of your “ducks in a row” before going there.
