Last month I signed a sales contract for the sale of my house. Since then, my wife has been having complications with pregnancy and may need to be placed on bed rest. I’d like to cancel the sales contract and allow my wife to take the time she needs. How can I get out of the sale?

When I saw your subject line, I thought “Oh not again!!”. I was all ready rip you up one side and downt he other. Most of those posts have some patently lame reason for backing out. Yours is the first understandable reason I’ve seen. Congratulations.

Anyway, I would have my attorney make up a release of liability for the buyer to sign, then I’d return all of his deposit, and reimburse him for any out of pockets (like loan app fee, title search, survey, that sort of thing). Then I’d tack on an appropriate bonus for his time and effort invested.

Second plan might be to just try to kick the closing date out a few months.

Either way, do it in your attorney’s office if possible.
