Call your title agent but I think that this needs to go through probate so that deed is transferred as the seller needs to sign and currently that’s not possible!! I’m pretty sure this is correct (probate, which could take a while) but again, a title agent can answer that immediately for you!

Hi All,

One of my sellers inherited a house through a valid will after his parents passed a year ago. But the deed is still in parents name. How can son give title if not on deed? Do we put him on deed through some procedure? How?

Or does he show death certificates and valid will sometime before closing as sufficient?

Many states allow a process for small estates that allows for affidavits of heirship to be done. It may be better to misplace the will and not probate it if there are not other considerations.
